Last updated: 4 August 2026
These Terms and Conditions ("Terms") govern the provision of pest control, termite management, weed control and related services (the "Services") by BioStrike Pest Solutions ("BioStrike", "we", "us" or "our"), ABN 00 000 000 000, of 35 Arrowtail Street, Chisholm NSW 2322, to any person or business that engages us ("you" or the "Customer").
By requesting a quote, accepting a quote, booking a service, or allowing us to attend your property, you agree to be bound by these Terms. Please read them carefully. Nothing in these Terms limits any rights you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
1. QUOTES AND AGREEMENT TO PROCEED
- Quotes are provided based on the information available at the time, including any description you give us of the property and the pest issue.
- Quotes are valid for 30 days unless otherwise stated, and may change if the scope of work, site conditions or access change once we attend.
- Accepting a quote verbally, in writing, or by confirming a booking constitutes acceptance of these Terms.
- Where the actual scope of work differs materially from what was quoted, for example a hidden infestation or unexpected access issue, we will discuss any price change with you before proceeding.
2. BOOKINGS, ACCESS AND SITE CONDITIONS
- You must provide safe and reasonable access to all areas requiring treatment or inspection, including the interior, roof void, subfloor and exterior where relevant.
- You are responsible for securing pets, moving vehicles, and advising us of any relevant hazards (such as aggressive animals, structural concerns or restricted areas) before we attend.
- If safe access cannot be provided, we may be unable to complete all or part of the service, and a call-out or partial service fee may apply.
- We may reschedule a booking due to severe weather, safety concerns, or circumstances beyond our reasonable control, and will contact you to arrange a new time as soon as practicable.
3. CANCELLATIONS AND RESCHEDULING
- We ask for at least 24 hours' notice to cancel or reschedule a booked appointment.
- Cancellations with less than 24 hours' notice, or a missed appointment where no one is available to provide access, may incur a call-out fee to cover the technician's allocated time.
- We will always try to accommodate genuine emergencies and will use reasonable discretion when applying this clause.
4. PAYMENT
- Payment is due on completion of the service unless otherwise agreed in writing, such as for larger commercial contracts invoiced on trading terms.
- We accept the payment methods advised at the time of booking or on the invoice.
- Overdue accounts may attract a reasonable administration fee and may be referred for debt recovery, with any associated reasonable costs payable by you.
- Prices are in Australian dollars and, unless stated otherwise, include GST where applicable.
5. NATURE OF PEST AND TERMITE TREATMENTS
- Pest control treatments manage and reduce pest populations using products and methods registered and approved for use in NSW; they do not guarantee the permanent or absolute elimination of all pests, as re-infestation can occur from neighbouring properties, new entry points or changed conditions.
- Termite inspections are visual assessments of accessible areas only, carried out in line with the relevant Australian Standard (AS 4349.3 for property inspections and AS 3660.1 for termite management systems); we cannot detect or report on activity in areas that are not visible or safely accessible, such as within wall cavities, under fixed floor coverings, or behind fixed furniture and stored goods.
- Termite management systems reduce, but cannot completely eliminate, the risk of termite entry or damage, and depend on ongoing maintenance and regular inspection to remain effective.
- Weed treatments depend on weather, weed species, growth stage and soil conditions, and results and timeframes can vary accordingly.
- You are responsible for informing us of any known allergies, sensitivities, pregnancy, pets or fish tanks/ponds on the property so we can plan the treatment appropriately.
6. WARRANTIES
- Where a service is described as including a warranty, the specific warranty period, the pests or issues it covers, and any conditions will be confirmed with you in writing before or at the time of service.
- Warranties are void where treated areas are disturbed, cleaned with incompatible products, renovated, or where conducive conditions identified in our report (such as moisture issues or garden beds above the slab edge) are not rectified.
- Warranty claims must be reported to us within the applicable warranty period, and we reserve the right to inspect the property before carrying out any warranty-related re-treatment.
- Nothing in this clause excludes any consumer guarantee that applies to you under the Australian Consumer Law.
7. REPORTS AND RECOMMENDATIONS
Inspection reports, including pre-purchase timber pest reports, reflect the condition of the property at the time of inspection and the areas that were reasonably accessible on that day. They are not a guarantee against future pest or termite activity, and recommendations made in a report (such as remedial building work or the removal of conducive conditions) are the responsibility of the property owner to action.
8. CUSTOMER RESPONSIBILITIES AFTER TREATMENT
- Follow any instructions provided by our technician regarding re-entry times, ventilation, and keeping people, pets and food items away from treated surfaces until dry or as advised.
- Do not clean, paint over, or otherwise disturb treated surfaces, bait stations or monitoring devices without checking with us first, as this can affect the treatment's effectiveness and any applicable warranty.
- Advise us promptly if you notice continued or renewed pest activity so we can assess whether a follow-up visit is required.
9. LIABILITY
- We carry public liability insurance and take all reasonable care in performing our Services in line with manufacturer instructions, label directions and industry best practice.
- To the extent permitted by law, our liability for loss or damage arising from our Services is limited to the cost of re-supplying the Service, except where the Australian Consumer Law provides you with a non-excludable right to a different remedy.
- We are not liable for pre-existing damage, damage caused by conditions not disclosed to us, or loss arising from your failure to follow post-treatment instructions or to action recommendations in a report.
- Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you under the Australian Consumer Law that cannot lawfully be excluded.
10. CANCELLATION OF ONGOING SERVICE AGREEMENTS
For customers on an ongoing or scheduled service program (such as a commercial pest control contract), either party may cancel the arrangement by providing 30 days' written notice, unless a different notice period is set out in a signed service agreement. Any services already delivered up to the cancellation date remain payable.
11. PRIVACY
We collect and handle personal information in accordance with our Privacy Policy, which forms part of these Terms by reference.
12. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes in our services, legal obligations or business practices. The version published on our website at the time of your booking applies to that booking.
13. GOVERNING LAW
These Terms are governed by the laws of New South Wales, Australia, and any dispute arising from them will be subject to the non-exclusive jurisdiction of the courts of New South Wales.
